Blumenau v Apple Computer, Inc.

Plaintiff Trevor Blumenau filed this action on September 29, 2004 in the United States District Court for the Northern District of Texas alleged infringement of U.S. Patent 5, 664,216 entitled “Iconic Audiovisual Data Editing Environment”.  Plaintiff’s complaint alleged that the Company’s Shake software program infringed the patent.  The parties have reached a settlement. Settlement of this matter did not have a material effect on the Company’s financial position or results of operation.

Plaintiff Trevor Blumenau filed this action on September 29, 2004 in the United States District Court for the Northern District of Texas alleging infringement of U.S. Patent 5, 664,216 entitled “Iconic Audiovisual Data Editing Environment”.  Plaintiff’s complaint alleges that the Company’s Shake software infringes the patent.  The Company received service of the complaint on March 8, 2005 and its response is not yet due.  The Company is investigating this claim.
