Royalty and License Revenues

Royalty and license revenue for the first quarter of 2009 totaled $1.6 million, compared to $0.3 million in the first quarter of 2008. Royalty and license revenues for the three months ended March 31, 2009 included royalty revenues from Orapred product sold by the sublicensee of $1.4 million and Kuvan royalty revenues for products sold in Japan and Europe of $0.2 million. Royalty and license revenues for the first quarter of 2008 included royalty revenues from Orapred product sold by the sublicensee of $0.3 million.

Royalty and License Revenues

Royalty and license revenue in 2008 totaled $5.7 million compared to $6.5 million in 2007. Royalty and license revenues in 2008 included royalty revenues from Orapred product sold by the sublicensee of $3.8 million, Kuvan royalty revenues for products sold in Japan of $0.4 million and a $1.5 million milestone payment related to the Japanese approval of Kuvan in July 2008. Royalty and license revenues in 2007 included royalty revenues from Orapred product sold by the sublicensee of $2.3 million and a $4.0 million milestone payment related to the one-year anniversary of FDA approval of the marketing application for Orapred ODT.

Royalty and license revenues, totaling $15.9 million in 2006, include a $7.5 million milestone payment related to FDA approval of the marketing application for Orapred ODT, received in June 2006 and a $4.0 million milestone payment related to the commercial launch of Orapred ODT, received in September 2006. Royalty and license revenues in 2006 also include $2.5 million related to the up-front license fee received from the third party. During 2007, we recognized $2.3 million in royalty revenues from Orapred product sold by the sublicensee, as compared to $1.6 million during 2006.

Royalty and License Revenues

Royalty and license revenues in the third quarter and first nine months of 2008 were $2.4 million and $3.9 million, respectively, compared to $0.6 million and $5.4 million in the third quarter and first nine months of 2007, respectively. Royalty and license revenues during the third quarter of 2008, included royalty revenues from Orapred product sold by the sublicensee of $0.8 million, Kuvan royalty revenues for products sold in Japan of $0.1 million and a $1.5 million milestone payment related to the Japanese approval of Kuvan in July 2008. Royalty and license revenues in the third quarter of 2007, included royalty revenues from Orapred product sold by the sublicensee of $0.4 million and a $4.0 million milestone payment related to the one-year anniversary of FDA approval of the marketing application for Orapred ODT. Royalty and license revenues in the first nine months of 2008 included $0.1 million of Kuvan royalty revenue, a $1.5 million one-time approval milestone related to the Japanese approval of Kuvan, and $2.3 million in Orapred royalty revenue for product sold by the sublicensee, compared to the first nine months of 2007 that included $1.2 million of Orapred royalty revenue and a $4.0 million milestone payment related to the one-year anniversary of FDA approval of the marketing application for Orapred ODT.

Royalty and License Revenues

In March 2006, we sublicensed our rights to the Orapred product line. Royalty and license revenues for the three and six months ended June 30, 2007 include royalty revenues from Orapred product sold by the sublicensee of $0.4 million and $0.8 million, respectively, compared to the three and six months ended June 30, 2008 which included $1.2 million and $1.5 million, respectively. Royalty and license revenues for the second quarter and first six months of 2007 include a $4.0 million milestone payment related to the one-year anniversary of FDA approval of the marketing application for Orapred ODT.

Royalty and License Revenues

Royalty and license revenues for each of the first quarters of 2007 and 2008 include royalty revenues from Orapred product sold by the sublicensee of $0.3 million.

BioMarin will also receive an additional milestone payment of $4.0 million on the first anniversary of FDA approval of Orapred ODT in June 2007.

As of September 30, 2006 BioMarin had cash, cash equivalents and short-term investments totaling $293.9 million.

Royalty and license revenues, totaling $9.4 million and $9.7 million for the second quarter and first six months of 2006, respectively, include a $7.5 million milestone payment related to FDA approval of the marketing application for Orapred ODT, received in June 2006. Royalty and license revenues for the second quarter and first six months of 2006 also include $1.7 million and $1.9 million related to the current period amortization of the $2.5 million up-front license fee received from the third party, respectively. During the second quarter and first six months of 2006, we recognized $41,000 and $83,000, respectively, in royalty revenues from Orapred product sold by the sublicensee.

Royalty and license revenues for the second quarter and six months of 2006 were $9.4 million and $9.7 million, respectively, and include receipt of a one-time milestone payment of $7.5 million from Alliant Pharmaceuticals, following FDA approval of Orapred ODT^™ (prednisolone sodium phosphate orally disintegrating tablets), amortization of the $2.5 million upfront license payment received from Alliant in March 2006, and royalties on net product sales of the Orapred product line, including Orapred^® (prednisolone sodium phosphate oral solution) and authorized generic products. Pursuant to a licensing

and acquisition agreement entered into with Alliant Pharmaceuticals on March 15, 2006, BioMarin will receive additional milestone payments contingent on the launch of Orapred ODT, which is expected to occur in early September of 2006, and on the first anniversary of FDA-approval of Orapred ODT in June 2007.

As of June 30, 2006 BioMarin had cash, cash equivalents and short-term investments totaling $305.9 million.

Royalty and License Revenues

During the first quarter of 2006, we recognized $42,000 in royalty revenues from Orapred product sold by the third party, subsequent to the sublicense of North American rights in March 2006. Royalty and license revenue for the first quarter of 2006 also includes $0.3 million related to the current period amortization of the $2.5 million up-front license fee received from the third party.
