(the “Company”) on June 30, 2009, announcing that it has reached agreement on a non-binding term sheet with certain beneficial owners holding greater than 75% of the outstanding aggregate principal amount of its 11% Senior Notes (the “Notes”) to restructure the Company’s outstanding obligations under the Notes, is filed herewith as Exhibit 99.1 and the information contained therein, including the term sheet attached thereto, shall be deemed “furnished” by the Company, and not “filed,” for purposes of Section 18 of the Securities Exchange Act of 1934, as amended.
