Defect Caused by INFOCUS’s Fault.  Section 18.1, 18.2, and 18.3 in this Agreement shall not be applicable to both parties when defect of Products is caused by INFOCUS’s fault including, but not limited to, the defect caused solely by INFOCUS’s design of Products; the defective specification provided by INFOCUS; and/or the defect caused by certain mechanical parts provided by INFOCUS.  When it is not certain which party’s fault causes defect of Products, the both parties faithfully confer and determine whether Section 18.1, 18.2, and 18.3 in this Agreement are applied or not.
