We had 30,360 active employees as of
December 31, 2008. Of that number, 19,794 were employees of SSA, most of who were employed at our retail marketing outlets.

Certain
hourly employees at our Catlettsburg and Canton refineries are represented by the United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers Union under labor agreements that expire on January 31,
2012. Negotiations are currently underway with the same union in Texas

that are scheduled to expire on May 31, 2012 at our St. Paul Park refinery and January 31, 2011, at our Detroit refinery.
