The Companys failure to enforce its trademarks or other proprietary rights could adversely affect its competitive position or the value of the Ruths Chris brand.
The Company owns certain common law trademark rights and a number of federal and international trademark and service mark registrations, most importantly the Ruths Chris Steak House name and logo, and proprietary rights relating to certain menu offerings. The Company believes that its trademarks and other
proprietary rights are important to its success and competitive position. Protective actions the Company takes with respect to these rights may fail to prevent unauthorized usage or imitation by others, which could harm the Companys reputation, brand or competitive position and, if the Company commences litigation to enforce its rights, cause us to incur significant legal expenses.
