12. MATCHING CREDITS ON SALARY DEFERRALS. Effective for Plan Years beginning on or after January 1, 2009, Section 4.2.3 of the Plan Statement shall be amended to read in full as follows:
4.2.3. Matching Credits. Effective for Plan Years beginning on or after January 1, 2009, the Executive Vice President, Human Capital shall cause to be credited to the Account of each Participant an additional matching amount equal to 50% of the amount credited to such Participants Account under Section 4.2.2 above. For this purpose, however, deferrals at a rate exceeding 6% of the Participants base salary shall be disregarded. Such matching amounts shall be credited as soon as administratively feasible on or after the day the related deferral of base salary is credited, and shall be fully vested.
