Item 1.04 Mine Safety

 

On November 8, 2012, Vulcan Materials Company (the “Company”) received an imminent danger order issued by the Mine Safety and Health Administration (“MSHA”) under section 107(a) of the Federal Mine Safety and Health Act of 1977 at our Central underground mine, in Fayette County, Kentucky. The order and an accompanying citation were issued when a loader operator was traveling underneath loose rock in the mine roof. The loader operator was removed from the area and the loose rock was mechanically scaled down. No injuries occurred from this incident.
