Item 1.04 Mine Safety

On November 27, 2012, Vulcan Materials Company (the “Company”) received an imminent danger order issued by the Mine Safety and Health Administration (“MSHA”) under Section 107(a) of the Federal Mine Safety and Health Act of 1977, at its Notasulga Quarry in Lee County, Alabama. The order and an accompanying citation were issued when a loader operator was observed not wearing a seat belt while operating the loader near the fuel containment area behind the maintenance shop. The loader operator was retrained on the Company and Federal safety requirements to wear seat belts while operating mobile equipment at all times. No injuries occurred from this incident.
