The Committee is authorized to make any payments when due as directed by court order in any action in which the Employer, Plan or the Committee has been named as a party. In addition, if a court determines that a spouse or former spouse of a Participant has an interest in the Participants benefits under the Plan in connection with a property settlement or otherwise, and pursuant to a domestic relations order (as defined in Code Section 414(p)(1)(B)), the Committee shall, notwithstanding any election made by a Participant, distribute the spouses or former spouses interest in the Participants benefits under the Plan to that spouse or former spouse in accordance with such domestic relations order.
