A prenuptial agreement, or prenup, is a contract between two individuals prior to their marriage. It specifies how the future couple's assets and liabilities will be divided in the event of a divorce or death.
From a legal perspective, it is crucial that both parties:
- completely and honestly disclose the nature and extent of all their assets and liabilities.
- hire separate attorneys while crafting a prenuptial agreement to ensure it is valid in a court of law. This provision ensures that each attorney co-writes the agreement with the client's best interests in mind.
- sign the agreement well in advance of their wedding so as to avoid the appearance of coercion.
- are fair. A court of law will not uphold a prenuptial agreement that sees one party taken advantage of or left destitute.
- sign the agreement in writing and in the presence of a notary public. Oral agreements will be deemed null and void.
